1. Acceptance of Terms

By using Always Keep Me ("the Service"), you agree to these Terms of Use. If you do not agree to these terms, do not use the Service.

You confirm that you are of legal age to form a binding contract and are not prohibited from using the Service under South African law or any other applicable jurisdiction.

2. Service Description

Always Keep Me, operated by Jittercat, provides a digital content creation service. You upload audio recordings and text, and we generate a downloadable digital image product containing:

• A visual waveform of your audio
• Your text exactly as provided
• A QR code linking to your audio file

Each purchase is for one voice memory product. Once generated and available for download, products cannot be edited, modified, or altered. All sales are final.

3. Preview and Verification

Unlimited Preview Access

The Service provides unlimited previews before purchase. You can:

• Preview the final product as many times as needed at no cost
• Check spelling, grammar, punctuation, and formatting
• Verify audio file accuracy and quality
• Regenerate the preview as many times as necessary
• Make unlimited changes to text and audio before purchase
• Test QR code functionality

Your Responsibility

You are solely responsible for verifying the accuracy of all content before purchase. This includes:

• Spelling, grammar, and punctuation
• Text formatting and layout
• Audio content and quality
• Visual appearance
• Completeness and accuracy of all information

Purchase Confirmation

By completing payment, you confirm that:

• You have reviewed the preview
• You have verified all content for accuracy
• You understand the product cannot be changed after purchase
• You have permission to use all content in your upload

Our Role

We provide the technical platform. We do not proofread, edit, or modify your content. The final product displays exactly what you submit. Content accuracy and quality are your responsibility.

4. File Requirements

Files must meet these requirements:

• Maximum size: 10MB per audio or video file
• Accepted formats: MP3, WAV, M4A, OPUS, OGG, MP4, MOV, and other standard formats
• Quality: Final product quality reflects your uploaded file quality—we do not enhance or improve files

Files exceeding limits or in unsupported formats will be rejected. We may modify these requirements as needed.

5. No Refund Policy

All Sales Are Final

Digital products cannot be returned once delivered. This is standard across the digital content industry. Because you have unlimited preview access and the final product matches your approved preview, no refunds are provided under any circumstances.

This policy applies to all purchases unless otherwise required by law.

No Refunds For:

• Errors you missed during preview
• Wrong audio file uploaded
• Changed mind after purchase
• Technical issues on your device
• Personal circumstances or emergencies
• Inability to use the product as intended
• Any other reason

Technical Defects

If you receive a corrupted file due to a technical defect on our end, please visit our retrieve page. We will work to resolve legitimate technical issues with delivered products.

Chargebacks

Initiating chargebacks or payment disputes for products received as previewed is a breach of these Terms and may result in service suspension and legal action to recover costs. Contact us directly to resolve any issues before pursuing chargebacks.

Nothing in this section limits mandatory consumer rights under applicable law that cannot be waived by contract.

6. Service Conditions

Service Availability

The Service is provided "as is" and "as available." We do not guarantee continuous or uninterrupted access. The Service may be unavailable due to maintenance, technical issues, or other circumstances.

Data Storage

We make no guarantees regarding ongoing storage or availability of content. Content may become inaccessible due to technical failures, security incidents, or other reasons. You are responsible for downloading and backing up your content immediately after purchase. Do not rely on our servers as your only storage.

Compatibility

We do not guarantee compatibility with all devices, browsers, operating systems, or printers. Compatibility issues are your responsibility.

7. Limitation of Liability

Maximum Liability

Our total liability for any claim is limited to the amount you paid for the specific product in question, not to exceed $4.00 USD.

Excluded Damages

We are not liable for:

• Indirect, consequential, or special damages
• Emotional distress or sentimental value loss
• User-submitted content errors
• Technical issues beyond our control
• Loss of data or content
• Any damages exceeding the purchase price

These limitations are essential to providing the Service at its current price and are standard for digital services.

8. User Content and Permissions

By uploading content, you represent and warrant that:

• You own or have rights to all uploaded content
• You have consent from anyone whose voice appears in recordings
• Your content does not infringe third-party rights
• Your content is legal and appropriate

Prohibited Content

Do not upload:

• Illegal, harmful, or abusive content
• Content exploiting minors
• Sexually explicit content
• Hateful or discriminatory content
• Content infringing intellectual property rights
• Malware or malicious code

You are solely responsible for all content you upload, including any legal consequences. We do not listen to, monitor, or verify any audio you upload, and your audio remains private. Please ensure your content complies with these rules and all applicable laws. We reserve the right to act if notified of prohibited content.

9. Security, System Integrity, and Prohibited Technical Conduct

Prohibition on Tampering and Security Breaches

You expressly agree not to tamper with, circumvent, disable, or otherwise interfere with any security-related features of the Service, or features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein. Any attempt to breach, compromise, or test the security of our systems, networks, servers, or infrastructure is strictly prohibited and constitutes a material breach of these Terms.

Prohibited Security Activities

Without limitation, you may not engage in or attempt to engage in any of the following activities:

• Unauthorized Access: Accessing or attempting to access any portion of the Service, associated systems, networks, servers, or databases that are not publicly accessible or for which you lack authorization, including accessing other users' accounts, data, or private information
• Security Vulnerability Testing: Probing, scanning, or testing the vulnerability of any system, network, or security measures, including port scanning, vulnerability scanning, penetration testing, or security audits without prior written consent
• Authentication Bypass: Bypassing, circumventing, disabling, or otherwise interfering with authentication mechanisms, access controls, security features, or usage restrictions
• System Exploitation: Exploiting any security vulnerability, bug, flaw, or loophole in the Service or underlying infrastructure for any purpose
• Credential Theft: Attempting to obtain, harvest, collect, or steal usernames, passwords, authentication tokens, API keys, or other credentials through any means
• Injection Attacks: Performing or attempting SQL injection, code injection, cross-site scripting (XSS), cross-site request forgery (CSRF), or any other injection-based attacks
• Reverse Engineering: Decompiling, disassembling, reverse engineering, or otherwise attempting to derive source code, algorithms, or trade secrets from the Service
• Network Interference: Interfering with, disrupting, or damaging the Service's operation, servers, networks, or infrastructure, including through denial-of-service attacks, distributed denial-of-service attacks, flooding, mail-bombing, or crashing
• Malicious Code Distribution: Introducing, uploading, transmitting, or distributing viruses, trojans, worms, logic bombs, time bombs, malware, spyware, ransomware, or any other malicious or harmful code
• Data Harvesting: Using automated tools, bots, scrapers, crawlers, spiders, or similar technology to extract, harvest, collect, or mine data from the Service without authorization
• API Abuse: Abusing, exploiting, or making excessive calls to any APIs, endpoints, or services beyond their intended use or documented limitations
• Payment System Manipulation: Attempting to manipulate, bypass, or interfere with payment processing systems, pricing mechanisms, promotional codes, or checkout processes
• File System Manipulation: Attempting to access, modify, delete, or corrupt files, databases, or storage systems not intended for user access
• Session Hijacking: Stealing, hijacking, or otherwise compromising user sessions, cookies, tokens, or authentication states
• Privilege Escalation: Attempting to gain elevated privileges, administrative access, or permissions beyond your authorized user role

Prohibited Technical Manipulation

You further agree not to:

• Modify, adapt, translate, or create derivative works based on the Service
• Remove, obscure, or alter any copyright, trademark, or proprietary rights notices
• Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks
• Attempt to gain unauthorized access to any services, accounts, computer systems, or networks connected to the Service
• Use any robot, spider, scraper, or other automated means to access the Service for any purpose
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein
• Forge headers or otherwise manipulate identifiers to disguise the origin of any content transmitted through the Service
• Frame or mirror any part of the Service without our prior written authorization
• Use any meta tags or other hidden text utilizing our name or trademarks
• Engage in any activity that circumvents or violates the integrity of our rating, feedback, or review systems

Rate Limiting and Resource Usage

You agree to respect all rate limits, resource quotas, and usage restrictions imposed by the Service. You may not attempt to circumvent, bypass, or exceed these limitations. We reserve the right to implement technical measures to enforce fair usage, including throttling, temporary suspension, or account termination for excessive or abusive use patterns.

Monitoring and Detection

We employ various security measures, monitoring systems, and detection mechanisms to identify suspicious activity, unauthorized access attempts, and violations of these Terms. We actively log and analyze system access patterns, security events, and anomalous behavior. You consent to such monitoring as a condition of using the Service.

Security Research Exception

If you are a security researcher and wish to conduct authorized security testing, you must contact us at security@alwayskeep.me before conducting any testing. Unauthorized security testing, even with good intentions, is strictly prohibited. We will work with legitimate researchers through a coordinated disclosure process. Good faith security research conducted with prior written authorization and in accordance with our security policy will not be considered a violation of these Terms.

Reporting Security Vulnerabilities

If you discover a security vulnerability or potential security issue in the Service, you must report it immediately to security@alwayskeep.me. Do not exploit, publicize, or disclose the vulnerability to others. Do not access, modify, or delete data beyond what is necessary to demonstrate the vulnerability. We appreciate responsible disclosure and will work promptly to address legitimate security concerns.

Consequences of Security Violations

Violations of this section constitute material breaches of these Terms and may result in:

• Immediate Account Termination: Your account and access will be terminated immediately without notice or refund
• Service Bans: You will be permanently banned from using the Service, and future attempts to register or access the Service will be blocked
• Legal Action: We will pursue all available legal remedies, including civil litigation and criminal prosecution. Security breaches may constitute violations of laws including but not limited to the Computer Fraud and Abuse Act (CFAA), Computer Misuse Act, cybercrime laws, and similar statutes in various jurisdictions
• Law Enforcement Cooperation: We will cooperate fully with law enforcement authorities and may report violations to appropriate agencies, including providing logs, evidence, and testimony
• Financial Liability: You will be liable for all damages, losses, costs, and expenses incurred as a result of your violations, including but not limited to: investigation costs, remediation expenses, legal fees, data breach notification costs, business interruption losses, and reputational harm
• Injunctive Relief: We may seek injunctive relief to prevent further violations
• Public Disclosure: We reserve the right to publicly disclose information about security violations and enforcement actions taken

Third-Party Security Tools

Use of third-party security testing tools, vulnerability scanners, or penetration testing software against the Service without prior written authorization is prohibited. This includes but is not limited to tools such as Metasploit, Burp Suite, OWASP ZAP, Nmap, SQLmap, and similar applications when used to test our systems.

No Security Guarantees

While we implement commercially reasonable security measures, we make no warranty or guarantee regarding the security of the Service. You acknowledge that no system is completely secure and that security breaches may occur despite our efforts. We are not liable for unauthorized access to your content resulting from vulnerabilities or security incidents, except where required by law.

Your Security Responsibilities

You are responsible for:

• Maintaining the security and confidentiality of your account credentials
• Using strong, unique passwords
• Not sharing your account access with others
• Promptly reporting any suspected unauthorized access to your account
• Securing your own devices and network connections when accessing the Service
• Logging out of your account when finished, especially on shared devices

Cooperation with Investigations

If we suspect or detect potential security violations, you agree to cooperate fully with our investigation, including providing information, documentation, and access as reasonably requested. Failure to cooperate may be treated as evidence of wrongdoing and result in account termination and legal action.

Preservation of Rights

Nothing in these Terms limits our right to take any technical, legal, or operational measures necessary to protect the security and integrity of the Service. We reserve all rights and remedies available under law, whether or not specifically enumerated in these Terms. Our decision not to enforce any provision of this section in a particular instance does not waive our right to enforce it in the future.

10. Intellectual Property

Your Content

You retain ownership of content you upload. You grant us a license to store, process, and use your content to provide the Service. This license continues as needed for technical and legal purposes.

Our Platform

All rights in the Service—including software, designs, and branding—remain our property. You may not copy, modify, or reverse engineer the Service.

11. Payment Processing

We use a payment processing. By making purchases, you agree to their Terms of Service and Privacy Policy. We are not responsible for payment processing issues, which are governed by their policies.

12. Intended Use

The Service is intended for personal, commemorative, and entertainment purposes. It is not designed for critical, time-sensitive, or irreplaceable needs. Do not rely on the Service for important events without backup plans. We are not responsible for consequences arising from Service unavailability or malfunction.

13. Data Deletion

You may request deletion of your content at alwayskeep.me/delete. Deletion is immediate and permanent. Deleted content cannot be recovered. We may retain transaction records as required by law.

14. Service Modifications

We may modify, update, or discontinue the Service or these Terms at any time without notice. Continued use after modifications constitutes acceptance. We may suspend or terminate accounts for Terms violations. Service discontinuation does not entitle you to refunds.

15. Dispute Resolution

Contact Us First

Before pursuing legal action, contact us at legal@alwayskeep.me to attempt informal resolution. Allow 30 days for resolution.

Governing Law and Jurisdiction

These Terms are governed by South African law. All disputes are subject to the exclusive jurisdiction of South African courts.

16. Indemnification

You agree to indemnify and hold harmless Jittercat, Always Keep Me, and affiliated parties from all claims, damages, and expenses arising from your use of the Service, your content, or your violation of these Terms or applicable laws.

17. General Provisions

• Force Majeure: We are not liable for failures due to circumstances beyond our control
• Severability: Invalid provisions do not affect remaining Terms
• Age Requirement: You must be at least 18 years old to use the Service
• Assignment: We may transfer our rights. You may not transfer yours without permission
• Entire Agreement: These Terms and our Privacy Policy constitute the complete agreement
• Export Compliance: You must comply with all applicable export and trade laws
